How to Get a Preliminary Injunction

The success of your business rides on the many actions of everyone employed at your company, whether it’s the work they do or the ideas they generate. One of the most vital things any employee must do is protect the livelihood of a business by keeping any pending future ventures and trade knowledge confidential. While most employees do not violate their confidentiality agreements or the trust of their employers, some do unfortunately, putting the company at-risk for losing a substantial amount of business and revenue. Once a trade secret has been leaked, one action that a company can take is to file for a preliminary injunction. The steps to doing this can be complicated, unless you have the aid of a highly qualified and knowledgeable business attorney.

At Slater, Kennon & Pugh, Ltd.LLP, our Austin trade secrets litigation attorneys know how important protecting your information can be and the stress it can put on your company when that information is leaked. Contact our team of legal professionals at 512-472-2431 to discuss how we can help you in this time of need.

The Steps

A preliminary injunction is a type of injunction that is filed early on during a case in order to prevent the injurious party from continuing their damaging actions while the court decides whether or not they are causing irreparable harm.

  • A lawsuit or petition must be filed against the offending party
  • The company or person filing the lawsuit/petition must display that irreparable harm will be caused if the person does not desist with their actions, the harm caused will be worse for the plaintiff and that the injunction will be beneficial to the general public.

After the court reviews the case and request for a preliminary injunction, they will decide whether or not a preliminary injunction should be awarded to protect the plaintiff while the case is being decided.
