Manufacturing Defects

When you are suddenly injured by a product, the last thing on your mind is what caused the injury. There are two major types of product defects: design defects and manufacturing defects. The way in which the product is flawed plays a large part in the determination of fault.

A design defect is a flaw in the design of the product that causes it to fail. That is, something inherent in the product’s design that causes it to fail. This means that every product made from the design will be flawed in the same way. An example of this might be a chair that is designed with only two, rather unsupportive legs, causing the chair to be extremely un-sturdy.

Conversely, a manufacturing defect is a defect that is caused by the improper construction of a product. Manufacturing defects vary because their flaws result from a deviation to the design. The manufacturing defect is a completely unplanned defect. It is considerably easier to prove a manufacturing defect in court. Should a manufacturing defect be shown to have caused an injury, the company will almost certainly be found liable.
